Did We Make You Smile Survey Prize Draw Terms and Conditions

  1. These terms and conditions (“Terms and Conditions”) set out the basis on which you may participate in the free prize draw described below (the “Promotion”).
  2. The Promotion is operated by Compass Contract Services (U.K.) Limited, a company registered in England & Wales under number 02114954 whose registered office is at Parklands Court, 24 Parklands, Birmingham Great Park, Rubery, Birmingham B45 9PZ (the “Promoter”).
  3. The Promotion is managed by the Promoter’s sub-contracted operator Service Monitor Limited, a company incorporated in England & Wales under number 04160858 whose registered office is at Richmond House, Walkern Road, Stevenage, Hertfordshire, SG1 3QP.
  4. By entering the Promotion, you accept these Terms and Conditions in full. If you do not accept these Terms and Conditions in full, you should not enter the Promotion. If you enter the Promotion but subsequently seek not to accept the Terms and Conditions in full, you will not be eligible to win a Prize (as defined below).
  5. The Promotion is open to all residents of Great Britain (excluding Northern Ireland) who are over the age of 18.
  6. Employees of the Promoter (or its affiliated companies), or its sub-contracted operator, and their immediate families, or other persons professionally connected with the Promoter, the sub-contracted operator and the Promotion are not eligible to participate.
  7. To enter the Promotion, you need only to have completed the “Did We Make You Smile?” survey and provided the required contact information so that you can be contacted should you be a Winner (as defined below).
  8. No purchase is required to enter the Promotion. Only one entry per visit to one of the Promoter’s restaurants or cafés operating the “Did We Make You Smile?” customer survey is permitted.
  9. The Promotion opens on 16 September 2019 with draws taking place on the 15 of every month. The first draw shall be on the 15 October 2019 and the Promotion shall run until the final draw on 15 April 2020 (“Promotional Period”) although may be closed early at the Promoter’s sole discretion.
  10. All eligible entries received during the period from and including the 16 day of one month to and including the 15 day of the next following month will be entered into the next draw to occur following the date of entry.
  11. The Promoter accepts no responsibility for failed entries for any technical, telecommunication or website error. Following each draw, all entries are wiped from the Promotion system which shall re-commence collecting entries from the day after each draw.
  12. The prize is £50 (fifty pounds sterling) of Love2Shop Vouchers (the “Prize”) and the Promoter will draw 5 winners (each, a “Winner”) randomly per month during the Promotional Period.
  13. The Prize is as stated only. It is non-transferable, non-refundable and cannot be exchanged for any cash alternative or auctioned in whole or in part. The Promoter reserves the right to provide an alternative prize of equal or greater value in the event of unforeseen circumstances.
  14. Each Winner will be notified using the email address provided, when signing up to enter the Promotion, within 14 days of the draw.
  15. If a Winner fails to respond to the notification and confirm their full name & e-mail details for identification purposes and so that the Promoter can post the Prize for award of the Prize within 21 days of notification, the Promoter reserves the right to select an alternative Winner at random from all other eligible entries received during the Promotional Period and award the Prize to that person.
  16. In order to claim the Prize, the Winner will be required to confirm their contact details. The Prize will then be sent to the Winner by post within 30 days of receipt of the Winner’s confirmation. The Promoter accepts no responsibility for any Prize which is not received by a Winner due to incorrect or incomplete contact details having been provided.
  17. Any Prize returned to sender or undelivered due to incorrect or incomplete details having been provided by a Winner will be deemed unwanted and that Winner’s claim to a Prize will be forfeited.
  18. The Winner may be required to take part in reasonable post-award publicity and the Promoter reserves the right to publish the Winners’ names and postal towns on restaurant customer notice boards and on its website.
  19. The names of the Winners will be available upon request by sending a stamped addressed envelope to the Promoter.
  20. By entering the Promotion, participants agree that the Promoter may use personal data relating to participants for the purposes of administering the Promotion (including via its sub-contracted operator) in accordance with these Terms and Conditions.
  21. Participants’ personal data will not otherwise be disclosed to third parties without the relevant participants’ prior consent. In particular, participants’ personal data will not be used for any marketing purposes.
  22. The Promoter reserves the right to amend or temporarily suspend the Promotion in the event of any unforeseen circumstances or technical reasons outside its reasonable control which make this unavoidable, with no liability to any participant or third party.
  23. The decisions of the Promoter are final and no correspondence will be entered into.
  24. To the fullest extent permitted by law, the Promoter accepts no liability for any damage, loss, injury or disappointment suffered by any participant entering the Promotion or as a result of accepting the Prize.
  25. The Promotion and these Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
